Artificial Intelligence
We help both buyers and sellers navigate the unique contracting issues raised by artificial intelligence in Canada. This includes special concerns related to generative AI and other machine learning systems, such as disputes over IP rights in outputs, trade secret risks related to prompts and training data, and liabilities surrounding privacy, defamation, and discrimination. We stay abreast of the rapidly changing developments in Canadian AI regulation, including the proposed Artificial Intelligence and Data Act (AIDA) and ongoing discussions regarding its implications for AI development and deployment.
We also work on contracts for non-generative systems using extractive AI. Our AI-related services include drafting standard Terms of Use and other user agreements, negotiating contracts with suppliers and strategic allies, and advising on related IP concerns within the Canadian legal framework.
